Privacy Policy

This Privacy Policy describes the privacy practices of AcreMaps, LLC DBA Acres (“Acres,” “we,” “us,” “our, collectively”). This Privacy Policy applies to our website visitors, mobile application (“App”) users, business contacts, customers, users, and any other individual who interacts with us.

Acres is a land intelligence platform that helps professionals analyze, value, develop, map, and manage land throughout the continental United States. It aggregates and organizes nationwide parcel data, ownership, zoning, and more from thousands of sources into a unified, searchable system so users can make faster, data-driven decisions.

Personal information we collect

If you choose to create an account, download articles or other marketing content, or register for a newsletter or an event through our website, contact us about our products and services, provide us with feedback, or apply for a job, we might ask you to provide certain personal information. We may collect information you submit using a form on our website or mobile app even if you do not affirmatively submit that form, such as by clicking the “submit” button.

We also collect publicly available personal information from various sources to power our intelligence platform that we make available to individual and business users. 

Information You Provide to Us

  • Contact Information, such as your first and last name, email and mailing addresses, phone number and/or company.

  • Payment and transaction information needed to complete your transactions on Acres, through our payment service providers, Stripe and RevenueCat, including name, payment card information, and billing information. Please note that this information is directly collected and processed by Stripe and RevenueCat, and Acres does not have access to payment card numbers. Please see the “Payment processors” section below for additional information regarding how our third-party payment processors handle your personal information.

  • Feedback or correspondence, such as information you provide when you contact us with questions, feedback, product reviews, or otherwise correspond with us online.

  • Usage information, such as information about how you use our services and interact with us, including information associated with any content you might upload to our services or otherwise submit to us, and information you provide when you use any interactive features of our services.

  • Marketing information, such as your preferences for receiving communications about our activities, events, publications, and details about how you engage with our communications.

  • Data contributions you provide to Acres through your account, such as saved maps and associated customizations, private data layers, and respective attachments.

  • Geolocation data. If you enable geolocation services on our App, the App collects your precise geolocation data, including GPS coordinates, timestamps, and movement paths, to track and map activities. This data helps provide personalized features, such as route tracking, activity history, and optimized mapping functionality.

  • Inputs.  If you use our artificial intelligence (“AI”) enhanced features such as Deed Ai, AI Chat, Site Planner and/or Acres Intelligence, your prompts, documents and usage data into these features will be collected and shared with our third-party AI providers who are considered sub-processors to assist us with analyzing data to provide the Services to you. Acres has a DPA in place and has implemented a Zero Data Retention Policy with these sub-processors and they are prohibited from training their models on any inputs.

  • Other information that we may collect, which is not specifically listed here, but which we will use in accordance with this Privacy Policy or as otherwise disclosed at the time of collection.

Information We Obtain From Third Parties

  • Social media information. We may maintain pages on social media platforms, such as Facebook, LinkedIn, Instagram, and other third-party platforms. When you visit or interact with our pages on those platforms, the platform provider’s privacy policy will apply to your interactions and their collection, use and processing of your personal information. You or the platforms may provide us with information through the platform, and we will treat such information in accordance with this Privacy Policy.

  • Third-party login information. When you link, connect, or login to our services with a third-party service (e.g., Google, Facebook, or LinkedIn), you direct the service to send us information such as your registration, friends list, and profile information as controlled by that service or as authorized by you via your privacy settings on that service.

  • Information about landowners. We may obtain personal information about landowners – such as the owners’ contact information, the value of land, sales or mortgage history, and other related details – from third-party data providers and publicly available sources such as governmental records. We make this information available to individuals and business users as part of our data and intelligence platform.

  • Marketing information. We may collect information about marketing leads from third-party data providers and our marketing partners. We may also receive professional contact and company data from lead enrichment and sales intelligence providers.

  • Age signals from app stores. Where required by applicable law, we receive age category and related parental consent status signals about App users from the app store through which you downloaded our App (for example, through the Apple Declared Age Range API or the Google Play Age Signals API). These signals indicate an age range or age category, not your date of birth. We use these signals solely to enforce age-based access restrictions, to comply with our legal obligations, and to implement safety-related features and defaults. Consistent with the principle of data minimization, we do not use age signals for any other purpose, we do not sell or share them or disclose them to any third party except as required by law, and we do not retain them after the age verification check is complete.

Automatic data collection

We and our service providers may automatically log information about you, your computer or mobile device, and your interaction over time with our services, our communications, and other online services, such as:

  • Device data, including but not limited to, your computer’s or mobile device’s operating system type and version, manufacturer and model, browser type, screen resolution, RAM and disk size, CPU usage, device type (e.g., phone, tablet), IP address, unique identifiers (including identifiers used for advertising purposes), language settings, mobile device carrier, radio/network information (e.g., WiFi, LTE, 4G), app installs and in-app events, and general location information such as city, state or geographic area.
  • Online and in-app activity data, including but not limited to, the pages or screens you viewed, how long you spent on a page or screen, browsing history, navigation paths between pages or screens, information about your activity in an app, on a page or screen, access times, and duration of access, and whether you have opened our marketing emails or clicked links within them.

  • Mobile SDK Tracking - Acres embeds third-party software development kits (SDKs), including AppsFlyer, in our mobile application, to collect certain data immediately upon opening of the mobile application, including, but not limited to device identifiers, IP address, app installs, in-app events and campaign attribution data for purposes of marketing attribution and analytics.

We Use the Following Tools for Automatic Data Collection:

  • Cookies, which are text files that websites store on a visitor‘s device to uniquely identify the visitor’s browser or to store information or settings in the browser for the purpose of helping you navigate between pages efficiently, remembering your preferences, enabling functionality, helping us understand user activity and patterns, and facilitating online advertising.

  • Local storage technologies, like HTML5, that provide cookie-equivalent functionality but can store larger amounts of data, including on your device outside of your browser in connection with specific applications.

  • Web beacons, also known as pixel tags, SDKs or clear GIFs, which are used to demonstrate that a webpage or email was accessed or opened, or that certain content was viewed or clicked.

  • Analytics providers, such as AppsFlyer, which are used to measure the effectiveness of ad campaigns, optimize ad spend and for purposes of tracking and attributing user actions within our products and specific marketing channels, including but not limited to mobile attribution analytics.

How We Use Personal Information

To operate our services, including to:

  • Provide, operate, maintain, secure and improve our services

  • Fulfill payments and transactions

  • Provide information about our services

  • Communicate with you about our services, including by sending you announcements, updates, security alerts, and support and administrative messages

  • Understand your needs and interests, and personalize your experience with our services and our communications

  • Respond to your requests, questions and feedback

For Geolocation Services 

In the course of using the service on our App, you may choose to allow us to collect your precise geolocation by turning on location services on your mobile device. We only process precise geolocation data to provide the Services. You can disallow our collection of precise geolocation data via the App at any time by turning off location services on your mobile device. Please note that certain features of the App may not function as intended without geolocation data.

For marketing and advertising

We and our advertising partners, which may or may not be affiliates of Acres, may collect and use your personal information for marketing and advertising purposes, including:

  • Email. We or our advertising partners may from time-to-time send you direct marketing emails as permitted by law, including, but not limited to, notifying you of special promotions, offers and events via email. You may opt out of our marketing emails as described in the “Opt out of marketing communications” section below.

  • Text messages. We may notify you via text message about upcoming events, new feature releases, news or other updates pertaining to Acres and any other alerts you request. If you would like more information about our do-not-call policy, or how to opt out, please review the “Opt out of marketing communications” section below. You may be liable for standard SMS and per-minute charges by your mobile carrier.

  • Interest-based advertising. We engage our advertising partners, including third-party advertising companies and social media companies, to display ads around the web. These companies may use cookies and similar technologies to collect information about your interaction (including the data described in the “Automatic data collection” section above) over time across our services, our communications and other online services, and use that information to serve online ads that they think will interest you. This is called interest-based advertising. We may also share information about our users with these companies to measure the effectiveness of our ad campaigns, to attribute app installs and user actions to specific marketing channels, to optimize ad spend on platforms like Google Ads, and to facilitate interest-based advertising to those or similar users on other online platforms. You can learn more about your choices for limiting interest-based advertising in the “Online tracking opt-out” section below.

For age assurance

Our App is intended only for users 18 years of age or older. Where required by applicable law, we use age category signals provided by app stores to verify whether an App user is an adult and to restrict access to the App accordingly. We process age signals only to the extent necessary for these purposes and delete the age range of users them once verification is complete, but for purposes of fulfilling our legal obligations to maintain a record of compliance mandated by applicable state app store accountability act legislation, we may be required to retain whether a user is over or under the age of 18, but will not retain the specific age range to which a user belongs.

To comply with law

As we believe necessary or appropriate to comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities.

For compliance, fraud prevention, and safety

To: (a) protect our, your or others’ rights, privacy, safety or property (including by making and defending legal claims); (b) enforce the terms and conditions that govern our services; and (c) protect, investigate and deter against fraudulent, harmful, unauthorized, unethical or illegal activity.

For research and development

We may create and use de-identified information for our business purposes, including to analyze the effectiveness of our services, to improve and add features to our services, and to analyze the general behavior and characteristics of users of our services. We may use this anonymous, aggregated, or de-identified data and share it with third parties for our lawful business purposes.

How We Disclose Personal Information

We may disclose personal information to the following parties.  

Affiliates

We may disclose personal information to our affiliates for each affiliate’s own purposes.

Acres data and intelligence platform users

We may disclose publicly available information about landowners to individual and business users of our data and intelligence platform, who may use such information for their own purposes.

Service providers

We may disclose personal information to third-party companies that provide services on our behalf or help us operate our services (such as customer support, hosting, analytics, consent management, CRM and lead enrichment, verification, sub-processing, email delivery, marketing (including attribution), identity verification, billing, and database management services).

Advertising partners

We may disclose personal information to third-party advertising companies, including for interest-based advertising, including contextual and cross-context behavioral advertising purposes described above.

Professional advisors

We may disclose personal information to professional advisors, such as lawyers, bankers, auditors and insurers, where necessary in the course of the professional services that they render to us.

For compliance, fraud prevention and safety

We may disclose personal information for the compliance, fraud prevention, and safety purposes described above.

Business transfers

We may sell, transfer or otherwise disclose some or all of our business or assets, including personal information, in connection with a business transaction (or potential business transaction) such as a corporate divestiture, merger, consolidation, acquisition, reorganization or sale of assets, or in the event of bankruptcy or dissolution.

How long we retain your personal information

We retain your personal information for as long as is reasonably necessary to fulfill the purposes for which it was collected or as is permissible under applicable law, including as necessary to comply with our legal obligations, resolve disputes, enforce our agreements, comply with applicable industry standards, and protect the security of our websites. Notwithstanding the foregoing, age category signals received from app stores are deleted once the age verification check is complete and are not retained.

Your Privacy Rights and Choices

Access or Update Your Information

If you have registered for an account with us, you may review and update certain personal information in your account profile by logging into the account.

Delete Your Account

Upon your request, we can delete your account and any personal information you have provided in your account. All account deletion requests should be submitted by completing this form or sending an email to [email protected]. All requests will be processed and completed within a commercially reasonable period of time. Please be advised that our ability to delete an Acres account and/or any personal information associated with that account may be limited for Enterprise customers.

Remove Your Personal Information From Our Data and Intelligence Platform 

If you are a landowner and wish to remove your personal information from our platform, please send an email to [email protected]. If you make this choice, information about your land will remain on our platform, but it will no longer be associated with your personal information. 

Opt Out of Marketing Communications

You may opt out of marketing-related communications – both email and text – by following the opt-out or unsubscribe instructions within the marketing communication we send you. You may also contact us at [email protected] to unsubscribe or learn more about our do-not-call policy. Even if you opt out of marketing-related communications, you may continue to receive service-related and other non-marketing emails. 

Online Tracking Opt-Out

There are a number of ways to opt out of having your online activity and device data collected through our services, which we have summarized below:

  • Cookie preferences manager. You can review and update your cookie and tracking preferences at any time through the cookie preferences manager available on our website and in the App’s preferences settings. Through the preferences manager, you may opt out of non-essential cookies and similar tracking technologies, including those used for analytics and interest-based advertising. Strictly necessary cookies and similar technologies that are required to operate our services, including those used to remember your consent choices,  remain active and cannot be disabled.

  • Geolocation data opt-out. You may opt out of our collection of your precise geolocation data by disabling location services on your mobile device, disallowing in-app tracking and/or opting out of tracking through your browser or specific websites (when available).

  • Blocking cookies in your browser. Most browsers let you remove or reject cookies, including cookies used for interest-based advertising. To do this, follow the instructions in your browser settings. Many browsers accept cookies by default until you change your settings. For more information about cookies, including how to see what cookies have been set on your device and how to manage and delete them, visit www.allaboutcookies.org.

  • Blocking advertising ID use in your mobile settings. Your mobile device settings, settings in the Apple App Store and Google Play Store and the Acres mobile app may provide functionality to limit use of the advertising ID associated with your mobile device for interest-based advertising purposes.

  • Using privacy plug-ins or browsers. You can block our services from setting cookies by using a browser with privacy features, like Brave, or installing browser plugins like Privacy Badger, DuckDuckGo, Ghostery or uBlock Origin, and configuring them to block cookies/trackers.

  • Platform opt-outs. The following advertising partners offer opt-out features that let you opt out of use of your information for interest-based advertising:

  • Advertising industry opt-out tools. You can also use these opt-out options to limit use of your information for interest-based advertising by participating companies:

Note that because these opt-out mechanisms are specific to the device or browser on which they are exercised, you will need to opt out on every browser and device that you use.

Do Not Track and Global Privacy Control

Some Internet browsers and extensions may be configured to transmit “Do Not Track” (DNT) or Global Privacy Control (GPC) signals to the online services that you visit. We treat GPC signals as a valid request to opt out of cookies and similar tracking technologies used for interest-based advertising on the browser or device from which the signal is sent. Personal Information Requests

Depending on your jurisdiction, you may request the following in relation to your personal information:

  • Information about how we have collected and used personal information. We have made this information available to you without having to request it by including it in this Privacy Policy.

  • Access to a copy of the personal information that we have collected about you. Where applicable, we will provide the information in a portable, machine-readable, readily usable format.

  • Correction of personal information that is inaccurate or out of date.

  • Deletion of personal information that we no longer need to provide the services or for other lawful purposes.

You are entitled to exercise the rights described above free from discrimination.

To submit personal information requests, please contact us as provided in the “How to contact us” section below. We may ask for specific information from you to help us confirm your identity. You may also designate an authorized agent to submit personal information requests on your behalf. We will require authorized agents to confirm their identity and authority, in accordance with applicable law.
 
In some instances, your choices may be limited, such as where fulfilling your request would impair the rights of others, our ability to provide a service you have requested, or our ability to comply with our legal obligations and enforce our legal rights.

Payment Processors

To facilitate financial transactions on our services, we use Stripe and RevenueCat. When you engage in a financial transaction, you direct us to share certain information with these payment processors, and you will provide other information—such as your credit card or bank account information—directly to them. We do not record or maintain this financial information. For more information on how transactions are handled, or to understand the data security and privacy practices of these payment processors, please refer to the privacy notices of Stripe and RevenueCat.

Job Applicants

When you apply for one of our open positions, we collect the information that you provide in connection with your job application. This includes name, contact information, professional credentials and skills, educational and work history, and other information that may be included in a resume or provided during interviews (which may be recorded). This may also include demographic or diversity information that you voluntarily provide. We may also conduct background checks and receive related information.

We use applicants’ information to facilitate our recruitment activities and process employment applications, including evaluating candidates and monitoring recruitment statistics. We also use successful applicants’ information to administer the employment relationship. We may also use and disclose applicants’ information to improve our website and for the compliance and protection purposes described above.

Other Sites, Mobile Applications and Services

Our services may contain links to other websites, mobile applications, and other online services operated by third parties. These links are not an endorsement of, or representation that we are affiliated with, any third party. In addition, our content may be included on web pages or in mobile applications or online services that are not associated with us. We do not control third-party websites, mobile applications or online services, and we are not responsible for their actions. Other websites and services follow different rules regarding the collection, use and sharing of your personal information. We encourage you to read the privacy policies of the other websites and mobile applications and online services you use.

Security Practices

We use organizational, technical and administrative measures designed to protect against unauthorized access, misuse, loss, disclosure, alteration and destruction of personal information we maintain. Unfortunately, data transmission over the Internet cannot be guaranteed as completely secure. Therefore, while we strive to protect your personal information, we cannot guarantee the security of personal information.

Children and Age Requirements

Our services are intended only for users 18 years of age or older. We do not knowingly permit individuals under 18 to create an account or use our services, and, where required by applicable law, we use age signals provided by app stores to enforce this restriction in our App. If we learn that we have collected personal information from a child under 13, or from any minor in violation of applicable law, without required parental consent, we will delete it.

Changes to this Privacy Policy

We reserve the right to modify this Privacy Policy at any time. If we make material changes to this Privacy Policy, we will notify you.
